Welcome to You OK ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the You OK mobile application ("App" or "Service") and any related services provided by You OK.

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. Description of Service

You OK is a mobile application designed to help users stay connected with friends and family through regular check-ins. Our Service includes:

  • Daily Check-ins: Schedule and complete regular check-ins to let your network know you're okay
  • Friend Network: Connect with friends and family members for mutual check-ins and peace of mind
  • Notifications: Receive reminders for your scheduled check-ins and alerts when friends miss their check-ins
  • Status Sharing: Share your check-in status (completed/missed) with your connected network
  • Account Management: Create and manage your profile and preferences

3. Eligibility

You must be at least 13 years old to use You OK. By using our Service, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • Your use of the Service is not prohibited by any applicable laws or regulations
  • All information you provide is accurate and truthful

4. User Accounts

4.1 Account Creation

  • You may create an account using your email address or through Google Sign-In
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

4.2 Account Information

  • You agree to provide accurate, current, and complete information during registration
  • You agree to promptly update your account information if it changes
  • We reserve the right to suspend or terminate accounts with false or misleading information

4.3 Account Security

  • You are solely responsible for the security of your account
  • You must notify us immediately of any unauthorized use of your account
  • We are not liable for any loss or damage arising from unauthorized account access

5. Acceptable Use

You agree to use You OK only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any applicable local, state, national, or international laws
  • Harass, abuse, or harm other users
  • Create false accounts or impersonate others
  • Send spam or unsolicited communications through the Service
  • Interfere with or disrupt the Service or servers

5.2 Content Standards

  • Do not share inappropriate, offensive, or harmful content
  • Respect other users' privacy and personal information
  • Do not use the Service to share false emergency information
  • Maintain respectful communication with your network

6. Important Safety Disclaimers

6.1 NOT AN EMERGENCY SERVICE

CRITICAL WARNING: You OK is NOT an emergency service and should NOT be relied upon for emergency situations.

  • In case of actual emergency, ALWAYS contact 112 or your local emergency services immediately
  • You OK is designed for peace of mind and regular check-ins, not emergency response
  • Missing a check-in does not guarantee any emergency response
  • We do not monitor check-ins for emergency situations
  • We do not provide emergency services or emergency contact services

6.2 Personal Safety Responsibility

  • You are solely responsible for your own safety and well-being
  • You OK is a communication tool, not a safety guarantee
  • Do not rely on the App as your only means of safety communication
  • Maintain appropriate emergency contacts and safety measures outside of the App

6.3 Technology Limitations

  • The Service depends on internet connectivity and may not always be available
  • Push notifications may be delayed or fail to deliver
  • Technical issues may prevent check-ins from being recorded or shared

7. User Responsibilities

7.1 Check-in Responsibility

  • You are responsible for completing your scheduled check-ins
  • Missing check-ins will notify your connected friends/family as designed
  • You should acknowledge missed check-ins to avoid unnecessary concern
  • Set realistic check-in schedules that you can maintain

7.2 Friend Network Management

  • Only connect with people you know and trust
  • Respect your friends' and family members' check-in schedules and preferences
  • Use notification preferences responsibly
  • Do not abuse the friend request system

7.3 Device and Connectivity

  • Ensure your device has appropriate internet connectivity
  • Keep the App updated to the latest version
  • Manage your device's notification settings appropriately
  • Maintain sufficient device storage and battery life

8. Privacy and Data

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

  • We collect minimal data necessary for the Service to function
  • Your check-in status is shared with your connected network as designed
  • You can delete your account and data at any time through the App
  • We do not sell your personal information

9. Service Availability

9.1 Service Uptime

  • We strive to maintain high availability but do not guarantee 100% uptime
  • The Service may be temporarily unavailable for maintenance, updates, or technical issues
  • We are not liable for any consequences of Service unavailability

9.2 Updates and Changes

  • We may update the App to improve functionality, security, or user experience
  • Some updates may be required to continue using the Service
  • We may add, modify, or remove features with appropriate notice

9.3 Maintenance

  • We may perform scheduled or emergency maintenance
  • We will provide reasonable notice for scheduled maintenance when possible
  • The Service may be temporarily unavailable during maintenance periods

10. Intellectual Property

10.1 You OK Ownership

  • You OK and all related trademarks, logos, and brand elements are our property
  • The App, including its design, functionality, and code, is protected by copyright and other intellectual property laws
  • You are granted a limited, non-exclusive license to use the App for personal use only

10.2 User Content

  • You retain ownership of any content you create or share through the Service
  • By using the Service, you grant us a license to use your content as necessary to provide the Service
  • You are responsible for ensuring you have the right to share any content you provide

11. Third-Party Services

You OK integrates with third-party services to provide functionality:

11.1 Google Services

  • Google Sign-In for authentication
  • Google's terms and privacy policies apply to their services
  • We are not responsible for Google's services or policies

11.2 Supabase

  • Database and backend services provided by Supabase
  • Supabase's terms and privacy policies apply to their services
  • We are not responsible for Supabase's services or policies

11.3 Push Notification Services

  • We use platform-specific push notification services (Apple Push Notification Service, Firebase Cloud Messaging)
  • These services have their own terms and privacy policies
  • We are not responsible for the reliability or availability of these services

12. Termination

12.1 Termination by You

  • You may delete your account at any time through the App settings
  • Account deletion will remove your data as described in our Privacy Policy
  • Some data may be retained for legal or operational purposes as described in our Privacy Policy

12.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Privacy Policy
  • Use the Service for illegal activities
  • Abuse other users or the Service
  • Provide false information or create fraudulent accounts

12.3 Effect of Termination

  • Upon termination, your right to use the Service ends immediately
  • We may delete your account and data in accordance with our Privacy Policy
  • Provisions of these Terms that should survive termination will remain in effect

13. Disclaimers

13.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13.2 No Warranty of Availability

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

13.3 Third-Party Content

WE ARE NOT RESPONSIBLE FOR ANY THIRD-PARTY CONTENT, INCLUDING CONTENT SHARED BY OTHER USERS OR INTEGRATED THIRD-PARTY SERVICES.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY SWISS LAW:

14.1 Limitation of Damages

IN NO EVENT SHALL YOU OK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. SINCE THE SERVICE IS FREE, THIS AMOUNT IS CHF 0.

14.3 Emergency Situations

WE ARE NOT LIABLE FOR ANY CONSEQUENCES RESULTING FROM RELIANCE ON THE SERVICE FOR EMERGENCY SITUATIONS OR SAFETY PURPOSES.

15. Indemnification

You agree to indemnify, defend, and hold harmless You OK and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you share through the Service

16. Changes to Terms

16.1 Right to Modify

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms in the App
  • Sending an email notification to your registered email address
  • Displaying a prominent notice in the App

16.2 Acceptance of Changes

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

17. Governing Law

17.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

17.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved in the competent courts of Switzerland. However, we both agree to first attempt to resolve any dispute through good faith negotiations.

17.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
